WHAT Personal Data Do We Collect and WHEN?

In order to provide you with the products or services you request, we ask for some personal data from you. For example, you make purchases, contact our consumer services, request communications, create an account, participate in our events or contests, or  When you use the platform. Also, when you request certain services in the store, we may ask you to log in to provide the services (e.g. size, size, preferences) to be associated with your account.

This personal data about you includes:

contact information, including name, email, phone number, and shipping and billing physical address;

personal information, including gender, city of residence, date of birth and purchase history;

KIDS

We comply with local laws and when children are under the legal age of their country of residence, they will be able to access our Platform.  We do not allow registration. We will seek parental consent for children participating in Solo Fitness's experiences and activities.

To Provide Features of the Platform and the Services You Request

When you use our platform, we will use your personal data to provide the requested product or service.  For example, when you make a purchase or participate in an event or promotion on solofitness.net, we will use the contact information you provide to contact you regarding that purchase, event or promotion. When you contact our consumer service, we will use information about you, such as delivery or payment information or the item you purchased, to help you resolve a problem or question.

If you use our Platform to monitor your fitness activity or physical characteristics, we will collect this personal data and store it for you to review on the Platform.  Your fitness activity data may include data you enter about your activity, or data collected by your device during your activity, such as location data and movement data.  We may use this activity data to calculate other information about your activity, such as distance run or calories burned, so that the calculated information may also be available to you as part of the Platform's functionality.

In many cases, in order to use certain features on our Platform, you may need to provide additional data to Solo Fitness or provide additional consent for certain data to be used in certain ways.  

To Submit Information about Our Products, Services, Events, and for Other Promotional Purposes

Upon your consent, we will send you marketing communications and news about Solo Fitness's products, services, events and other promotions that may be of interest to you.  You can opt out at any time after giving your consent.

Direct Marketing

If you are an existing Solo Fitness customer (for example, if you have placed an order with us), we may use the contact information you provide (unless you opt-out) to send you marketing communications about similar Solo Fitness products or services when permitted by applicable law. In other cases, we ask for your consent to send you marketing information.

Personalization

In addition to information you provide to us, we may also use information from other Nike products and services – such as your use of the Solo Fitness Platform, your visits to or purchases at Solo Fitness stores, your participation in Solo Fitness events and competitions – to personalize communications about products and services that may be of interest to you. In doing so, we may combine the information you provide to us with information we generate about your online activity, including internal insights and analytics.

To Run, Develop and Maintain Our Business, Products and Services

We use the personal data you provide to us to run our business.  For example, when you make a purchase, we use this information for accounting, auditing and other internal functions.  personal data about how you use our products and services to improve your user experience and diagnose technical and service issues; and  We may use it to help us manage our platform.

To Protect Ours or Others' Rights, Property, or Safety

We may also use your personal data about how you use our platform to prevent, detect or investigate fraud, abuse, illegal use and violations of our Terms of Use and to comply with court orders, government requests or applicable law.

For General Research and Analysis Purposes

We use data about how our visitors use our Sites, Apps and Services to understand customer behavior or preferences.  For example, we may use information about how Solofitness.net visitors search for and find products to better understand best practices for organizing and presenting the product offerings in our showcase.  

Using (Processing) Training Information

As discussed above, Solo Fitness collects data about your fitness activities or physical characteristics, collectively called Training Information, to provide our services on our Platform.  Due to the personal nature of this data, we try to provide you with clear information about how the Training Information will be used.  As this data may be considered sensitive in some jurisdictions, we take steps to protect and use this data and will seek your consent to use your Training Information when required by applicable law or under Solo Fitness' internal rules.

Other Purposes

We may also use your personal data in other ways and will provide specific notice at the time of collection and obtain your consent when necessary.

Legal Ground

To process your personal data  We rely on certain legal grounds depending on how you interact with our platform.

When you purchase Solo Fitness products from our platform, we need your personal data to fulfill our contract with you. For example, we need your payment and contact information to deliver your order.

When you use our Apps, we rely on your consent for processing and for certain limited purposes to fulfill our contract with you (for example, for in-App purchases). 

Process information about the effectiveness of our marketing campaigns, products, services, events and other promotional initiatives; operate, develop and maintain our business, products and services; protect ours or others' rights, property or safety; and for general research and analysis purposes, we also rely on other legal grounds, such as our legitimate interests as a business. We also process your personal data to comply with a legal obligation or to protect your vital interests.

SHARING Your Personal Data

Solo Fitness's Share

Solo Fitness shares your personal data with:

Nike entities for the purposes set out above and in accordance with the terms set forth above. 

Service providers who process personal data on behalf of Solo Fitness, for example, to process credit cards and payments, shipments and deliveries, host, manage and service our data, distribute emails, conduct research and analysis, manage brand and product promotions, and administer certain services and features .  When using service providers, we make agreements with them that require them to implement the necessary technical and organizational measures to protect your personal data. 

Other third parties, to the extent necessary to: (i) comply with a government request, a court order, or applicable law; (ii)  Prevents illegal uses of our Platform or violations of our Platform's Terms of Use and our policies; (iii) defend ourselves against third-party claims; and (iv) assist in fraud prevention or investigation (for example, counterfeiting).

Third-party targeted advertising providers who provide personalization and personalized advertising services to us. We use such services to match aggregated information we store with personal data in databases to create custom audiences and tailor advertisements to your interests on the Internet, including on social media, as permitted by applicable law. You can opt out of personalized ads and custom audiences using the relevant settings on our platform.

We may also transfer personal data we hold about you if we sell or transfer all or a portion of our business or assets (including restructuring, spin-off, dissolution or liquidation).

Your Sharing

When you use certain social features on our platform, you may create a public profile that may contain information such as your screen name, profile picture, or the city you live in.  You can also share content with friends or publicly, including information about your Solo Fitness activities.  To keep control of what information you provide through Solo Fitness' social features, we recommend that you use the tools we provide to manage Solo Fitness' social sharing.

PROTECTION and MANAGEMENT of your Personal Data

Encryption and Security  

We use a wide variety of technical and organizational security measures, including encryption and authentication tools, to protect the security of your personal data.

Retention of Your Personal Data  

Your personal data will be retained for as long as necessary to fulfill the purposes set out in this privacy policy. This generally means that we will keep your personal data as long as you keep your Solo Fitness account. With regard to personal data relating to the purchase of products, we retain them for a longer period of time to comply with legal obligations (for tax and sales laws and for warranty purposes).

You have the right to demand:

(i) to request information about whether we are processing any personal data about you, the purpose of processing and data recipients, if any, (ii) verifying whether your personal data is being processed in accordance with the purposes specified in this privacy policy, (iii) rectification, deletion or deletion of some personal data about you. to request the restriction of your personal data and to notify the third parties that receive your personal data in case of correction or deletion of your personal data, (iv) to object to the decisions made automatically about you, and (v) to claim compensation in case you suffer any damage due to unlawful processing of your personal data.
